# Eligibility and Restricted Regions

> Who can use Gains, how regional restrictions work in the app, and what they mean for your funds.

## No Account, No KYC

Gains has no accounts and no identity verification. You trade from your own wallet, and your funds stay in it until you open a trade.

## Terms of Service

Using Gains means accepting the [Terms of Service](https://gains.trade/terms-of-service). In particular:

* use of the site from the United States or its territories, or by US persons, is prohibited, whatever your IP address, and using a VPN to hide a US location is prohibited too;
* the site cannot be used by persons subject to sanctions;
* you are responsible for complying with the laws and regulations that apply where you are.

Gains cannot give legal advice on the rules of a specific country or province. If you are unsure, check them before trading.

## Regional Restrictions in the App

The app checks access by region, based on your IP address and other geolocation signals, for each asset category: cryptocurrencies, forex, stocks, indices and commodities. A category can be available in a region while another is not. For example, stocks and indices are blocked in the United States and OFAC-sanctioned regions.

When a category is restricted where you are, the trading panel shows **Restricted in your region** on its pairs, and you cannot open a trade on them.

* **To see your status**, connect your wallet on a live network (for example Arbitrum), select a pair from each category you want to trade, and look at the trading panel.
* **Practice Mode is not a test.** [Practice Mode](/gtrade-leveraged-trading/how-to-use-practice-mode), the **Demo Trading** network in the app, runs on a testnet, where the regional check is not applied, so a successful practice trade does not mean the same trade is available on a live network.

## Your Funds

Gains is non-custodial. The regional check applies to opening trades in the app: it never locks your funds, and it never stops you from closing a position. Your collateral stays in your wallet until you open a trade.
